IN NO EVENT SHALL TP MEDIA LLC’S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE TOTAL AMOUNT PAID BY YOU TO TP MEDIA LLC FOR PRODUCTS PURCHASED IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

IX. Governing Law and Dispute Resolution

Governing Law

These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the State of Missouri, United States, without regard to its conflict of law principles.

Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, the parties shall first attempt to resolve the dispute informally. If the dispute cannot be resolved informally, you and TP MEDIA LLC agree to resolve any claim through final and binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Cass County, Missouri.

You understand that by agreeing to arbitration, you are waiving your right to a trial by jury or to participate in a class action. Notwithstanding the foregoing, either party may bring an individual action in small claims court. You also have the right to lodge a complaint with relevant consumer protection authorities.

X. Miscellaneous Provisions

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, Refund and Return Policy, and Shipping Policy, constitute the sole and entire agreement between you and TP MEDIA LLC regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.

Waiver
